Web Design Modification:
Once the end product of a website is completed, or 30 days after your website is first published on the world wide web (whichever is sooner), requests to change, modify, add, delete or otherwise manipulate content are subject to our reasonable and customary web design fees of $48.00 per hour, with a one-half hour minimum on all requests. These include, for example, requests to change business addresses, contact email addresses or telephone numbers, business name changes, etc.. If you make a request via e-mail, we will reply with a link to this page, asking you to confirm agreement with our policies and fees. If you agree, we will perform the work and bill you via e-mail. If you wish to get an estimate of the time and charges involved, we will provide an estimate in our reply and only proceed when you have agreed. 

Server Access:
If you request administrative access in order to view server statistics or perform your own administrative duties, you relinquish all guarantees in our service level agreements, due to the fact that you have access to files, folders, permissions and other mechanisms that can render, alter or even delete your end-product. PLEASE BE CAREFUL, as we will not necessarily "fix" problems with your website that occur after we have given you an administrative password. We will attempt to fix problems at your request, but cannot guarantee our service. Standard service rates will apply.

Hosting Service Limitations and Exclusions:
If you request hosting service only, it is your responsibility to publish your site files to the hosting platform using the credentials we supply to you, or your appointed web designer. We can sometimes administer a 3rd party product (that is, a web design, or web application not created and tested by us) but we make no guarantees about the functionality, reliability, serviceability or performance of any third party product that is placed on our servers. We reserve the right to refuse or to delete any content or program that we deem harmful to the web public at large. If we are asked to administer a 3rd party product, we will respond with a reasonable fee structure to do so, including pre-testing the product for functionality and compatibility with our servers and hosting platform.

Template Access:
As an enhancement to certain websites, we offer password protected access to customized templates that reside on mywebmkt.com's host server. Access to these templates does not void your service level agreement, as you cannot access your website's host server through these templates. However, you are solely responsible for any content you upload, and because your template will be able to create WebAds that will be published to all affiliate templates, you are bound by the WebAds Access Agreement terms of use. We reserve the right to make minor alterations to the way in which data is displayed on these templates, in order to accommodate new features, enhancements, etc... that should not materially alter the quality of your content.

Confidentiality:
Your passwords and other private information are protected. No information regarding you or your account is ever shared with or sold to a third party. Likewise, we do not provide personal or contact information about your site visitors. Please do ask us to translate IP addresses or capture e-mail ID's of your site visitors. We do not use, promote or otherwise enable the practice of "spamming" and do not respond to any requests asking us to do otherwise--period. We provide the means for people who wish to volunteer contact info., etc. to do so through forms and links, and we endorse our end-product as an inexpensive and effective means to that end, but we will not perform any services or install software that we feel constitutes an invasion of privacy.

Search Engine Placement:
Unless otherwise specified in writing, we do not guarantee search engine placement or rankings. We do not have control over search engine technology, nor administrative control over the entities that manage that technology. We feel that our competence in creating an end product, optimized for search engine indexing on certain key terms and phrases is best exemplified by showing examples of sites we've designed with links to their actual site rankings by various search engines. We provide these examples here.

Web Design Refunds:
In the unlikely event that we cannot produce an acceptable Web Design end product, we will refund your purchase price, less a $90.00 service fee to cover necessary expenses incurred by mywebmkt.com in order to bring the intended end product to market, including domain name registration (if applicable), server set-up and other administrative tasks. Either party may make a determination that a satisfactory end-product cannot be reasonably obtained within the first 30 days of service, and proceed with the refund process. After that time, a refund is not available for the Web Design Fee. 

Domain Names:
If we have obtained a domain name on your behalf, our default registration process is to register the domain such that we have administrative control over it. We charge a $30.00 transfer fee to amend our default registration process. If, after your annual hosting agreement period expires, you decide not to renew hosting with mywebmkt.com, but wish to retain a domain registered or extended through our default process, we will charge the $30.00 transfer fee to unlock the domain. Additional requests to manage non-hosted domains will incur a $30 fee per change.

Files and Folders:
If you wish to obtain a hard-disk copy of your web directory files and folders, we will provide this to you on CD for a charge of $50.00. We will not under any circumstances, however, be held liable for any errors, problems or inability to open, alter or replicate these files elsewhere on the world wide web or any other operating system.

Renewals:
Annual renewal fees include hosting fees only. There may be an additional charge for domain name renewal if applicable. The charge to renew services on a current plan is equal to the annual hosting fee (as published here). We do not offer month to month hosting. We will invoice you by postal mail between 60 and 30 days prior to your renewal period in order to notify you of the expiration date, and to offer our services to renew your annual hosting plan. We may email a reminder 15-30 days prior to expiration, if payment has not been received by then. We will make no other attempt to contact you. If we have not received the renewal fee two weeks prior to expiration, we will begin the termination of services process.

Termination of Services / Reinstatement
If your services with us are terminated voluntarily, or by default, we cannot guarantee that they will be reinstated immediately, or at all. If your domain name has expired, it may be inactive for up to 90 days and / or it may be re-allocated, in which case you may be unable to reacquire it at all. If you wish to reinstate services, we will charge a $125.00 reinstatement fee in addition to the renewal fee.

Past Due Payments:
We often work on projects for days, or even weeks, in advance of billing. If you have received a bill that is "due on receipt" we expect payment within 14 days of the invoice date. If we have not received payment within 30 days of the invoice date, a late fee of $39.00 will be assessed and a second late notice will be sent. 45 days after the "due on receipt" date, hosting services will be suspended (if applicable), and all future work orders subject to payment in advance. Customers who have a history of late pay, may be placed on an accelerated schedule. The above applies to any due date on an invoice, including due dates for hosting renewals.
 

Service Level Agreements:
We unconditionally guarantee that our website end product will be cross-browser compatible and that all forms, components, links and installed software will function as intended during the term of your plan. Should a form or component fail for any reason, we will correct the problem at no charge (as long as you do not have access to the host server--which voids this agreement). Specific uptimes for hosting are guaranteed to follow normal industry standards and may vary slightly depending on the underlying provider guarantees.
